FREQUENTLY ASKED QUESTIONS ABOUT THE PROBATE PROCESS

What do I need to do to probate a will?
To complete the probate process, a number of steps must be carried out, documented and approved by the court. For example, the estate of the deceased will need to be inventoried and notice must be given to creditors. It may be appropriate to sell assets such as real estate. For all but the smallest estates, the advice of an attorney is essential.

How long does probate take?
Typically, for all but the smallest estates, probate will take at least 6-8 months.

How much does it cost to probate a will?
The fees for assistance from an attorney are usually paid by the estate of the deceased. The amount is limited by law to a percentage of the estate.
